Agreement to Terms

By accessing or using Oxic ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

Use License

Permission is granted to temporarily use Oxic for personal, non-commercial purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials
  • Use the materials for any commercial purpose or public display
  • Attempt to reverse engineer any software contained in the Service
  • Remove any copyright or proprietary notations
  • Transfer the materials to another person or mirror the materials on another server

Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

Subscription and Payment

Oxic offers subscription-based services. By subscribing, you agree to:

  • Pay all fees associated with your subscription
  • Automatic renewal unless cancelled
  • Price changes with 30 days notice
  • No refunds for partial subscription periods (except as required by law)

Subscriptions automatically renew monthly. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period.

User Content and Conduct

You are responsible for all content you post or share on the Service. You agree not to:

  • Post false, misleading, or fraudulent information
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Harass, abuse, or harm other users
  • Spam or send unsolicited communications
  • Interfere with or disrupt the Service
  • Use automated systems to access the Service without permission

We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts of repeat offenders.

Intellectual Property

The Service and its original content, features, and functionality are owned by Oxic and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you submit, but by submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of operating and promoting the Service.

Third-Party Services

Oxic integrates with third-party services, including:

  • Strava: For activity tracking and data synchronization
  • Stripe: For payment processing
  • OpenAI: For AI-powered coaching features
  • Resend: For email delivery

Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

Disclaimers

Health and Safety: Oxic provides training recommendations and coaching advice, but you are solely responsible for your health and safety. Always consult with a healthcare professional before starting a new exercise program. We are not liable for any injuries or health issues resulting from use of the Service.

Service Availability: We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. The Service is provided "as is" without warranties of any kind.

AI-Generated Activity Analysis: Coaching advice is generated by AI and should be used as guidance, not as a substitute for professional coaching or medical advice.

Limitation of Liability

To the maximum extent permitted by law, Oxic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Oxic and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

You may terminate your account at any time through your account settings. Upon termination, your right to use the Service will cease immediately.

All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Oxic operates, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the appropriate courts of that jurisdiction.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
